Terms of Service
These terms are a contract between you and Plaid Penguin Ltd, a company registered in Cyprus ("Plaid Penguin Studio", "we", "us"). They apply to the Lost at the Boardwalk mobile game (the "Game") and to plaidpenguinstudio.com (the "Website"). By downloading, installing or using the Game, or by using the Website, you agree to them. If you do not agree, do not use them.
1. Who may use the Game
You must be at least 13 years old, and old enough to agree to these terms where you live. If you are under the age of majority, a parent or guardian must agree on your behalf and is responsible for your use of the Game, including purchases. Our Privacy Policy explains how we handle information.
2. Your license
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and play the Game on devices you own or control, for your own non-commercial entertainment, in line with these terms and the rules of your app store. You may not copy, modify, reverse engineer or decompile the Game, sell, rent or sublicense it, or remove any notices from it, except where the law allows despite this restriction.
3. Coins and in-game items
Coins, power-ups, tool skins and other in-game items ("Virtual Items") are a limited license to use features of the Game. They are not property, have no cash value, cannot be sold, traded or transferred, and cannot be redeemed for money. Unused Virtual Items may be lost if you delete the Game without restoring your data, and we are not responsible for that. We may change the prices, amounts and rewards of Virtual Items, and may correct balances that result from an error or a violation of these terms.
4. Purchases
The Game is free to download and play. Optional purchases, such as coin packs, a starter pack and Remove Ads, are processed by Apple or Google under their payment terms. Prices are shown in the Game and may include taxes. Except where the law or your store's policy gives you a right to a refund, purchases are final and non-refundable. Refund requests go to the store that processed the purchase. Remove Ads removes banner and interstitial ads. It does not remove rewarded ads that you choose to watch. You can restore eligible purchases on a new device through the Game or your store account.
5. Ads and rewards
The Game shows ads served by third parties. Watching a rewarded ad is optional and may earn a reward, such as a continue or bonus coins. We do not control third-party ad content and are not responsible for it. If an ad fails to load or a reward is not granted, contact support and we will try to correct it.
6. Fair play and acceptable use
Do not cheat, exploit bugs, use bots or automation, tamper with game data, memory, network traffic or remote configuration, bypass ads or purchases, or interfere with the Game or our systems. Do not use the Game to break the law or to harass anyone. We may suspend or limit access, remove Virtual Items or end your license if you break these rules.
7. Ownership
The Game, including its code, art, music, level designs, text, names, logos and the Plaid Penguin Studio and Lost at the Boardwalk marks, belongs to us or our licensors and is protected by intellectual property laws. These terms do not give you any ownership in them. If you send us feedback or ideas, you let us use them without payment or obligation to you.
8. App stores and third parties
Apple and Google are not parties to these terms and have no obligation to provide support or maintenance for the Game. If the Game fails to meet a warranty that applies, you may notify the store and it may refund the purchase price where its rules allow. We, not Apple or Google, are responsible for the Game and for any claims about it. Apple and Google, and their subsidiaries, are third-party beneficiaries of these terms and may enforce them against you. You must also follow the terms of your device, network and store.
9. Updates and changes to the Game
We may update, change, suspend or stop the Game or any feature at any time, including adding new levels, worlds and events. If we shut the Game down, we will try to give reasonable notice where we can.
10. Disclaimers
The Game and the Website are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise the Game will be uninterrupted, error-free or free of harmful components. Some places do not allow certain disclaimers, so some of this may not apply to you.
11. Limit of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Game or the Website. Our total liability for any claim is limited to the greater of the amount you paid us for the Game in the 12 months before the claim and US$50. Nothing in these terms limits liability that cannot be limited by law, and you keep any consumer rights you have under the law where you live.
12. Governing law and disputes
These terms are governed by the laws of the Republic of Cyprus, without regard to conflict of law rules. Before starting a claim, please email us so we can try to resolve it informally. Subject to any rights you have under mandatory consumer law, claims must be brought in the courts located in Limassol, Cyprus, and you consent to their jurisdiction.
13. Changes to these terms
We may update these terms from time to time. We will post the new version here with a new date. If you keep using the Game after a change takes effect, you accept the updated terms. If you do not accept them, stop using the Game.
